Informing patients, consumers, healthcare professionals and third parties about the process of their personal data in the frame of reporting of adverse events and submission of quality complaints.
Galenica Pharmaceutical Company SA (hereinafter the “Company”) collects, stores and processes certain personal data provided to the Company by patients, consumers, healthcare professionals and third parties in the framework of reporting adverse effects and quality complaints.
The purpose of the information provided here is to inform these persons about the processing of their personal information by the Company in order to manage reports concerning adverse effects and quality complaints regarding medicines, cosmetics and other pharmaceutical preparations that the Company produces and/or markets in Greece.
What kind of personal data do we collect and store in our archives?
The categories of personal data collected from users of our products (patients and consumers), who report an adverse effect or a problem about the quality of our products (regardless of whether such adverse event is reported by them or by health care professionals) are those stipulate by the pharmaceutical legislation and the relative legal framework, and these are mostly the following:
a. patient’s initials or patient code number, gender, age, or age group
b. information regarding the pharmaceutical treatment or use of pharmaceutical preparations of the Company,
c. description of the adverse effect and/or quality problem of the pharmaceutical preparation and the outcome thereof and
d. in case of an adverse effect, the medical history of the patient.
The Company may exceptionally collect the patient’s name and surname and other identification information (e.g., their contact information) only in case of an event that required thorough follow-up of the patient’s/consumer’s course of health and of the case in general.
The categories of personal data that our Company collects and stores from health care professionals (doctors, pharmacists etc.) who report an adverse effect or submit a quality complaint are their name and surname, profession and contact information (phone and/or email address).
What are the purposes of and the legal bases for Processing Personal Data?
We collect, process and store personal data of users of the Company’s products (patients and consumers) and of health care professionals who report an adverse reaction or a quality complaint for the purpose of complying to the pharmaceutical legislation and the relative pharmaceutical legal framework regarding pharmacovigilance and quality assurance of medicines, cosmetics and other preparations that the Company manufactures and/or markets in Greece.
The legal basis for processing the above-mentioned personal data is our compliance with obligations arising from the regulatory and legal framework for medicines, cosmetics and similar preparations, as well as the assurance of high quality and safety standards on our medicines and further products.
To whom are your personal data disclosed?
In principle, your personal data are not disclosed to third parties. In exception, your data may be disclosed to third parties (for example, pharmacovigilance service providers) who help us record and evaluate reports on adverse effects and are bound to process your personal data exclusively on our behalf and based on our written instructions and not to their own benefit.
Furthermore, as set out by the relevant legislation, we disclose anonymous or pseudonymized data regarding the adverse effect to the competent authorities [such as the National Organization for Medicines of Greece (EOF), the European Medicines Agency (EMA) and the European database Eudravigilance], as well as to foreign Marketing Authorization Holders (MAH), who have granted us exclusive distribution rights for their medicines in Greece.
How do we process personal data and how long do we retain them?
We take every necessary measure to ensure the security, integrity and confidentiality of your personal data.
In principle, the physical and electronic archives of side effects reports and quality complaints are stored for a period of six (6) years after their initial registration. Exceptionally, identification data of patients/consumers (e.g., name and surname and contact information) are only kept for a period necessary to follow up the conclusion of the consumer/patient case and the receipt of all necessary data to accurately record the adverse effect and/or the quality complaint.
Your rights
Every patient, consumer, health care professional and third party who submits an adverse reaction or quality complaint report, has the right to request from the Company access to as well as rectification and conditional deletion of their personal data. They also have the right to request restricted processing of their personal information. These rights can be exercised by sending a letter or email to the Data Protection Officer of our Company to the address/email address mentioned below.
Additionally, the legislation enables the above-mentioned persons to file an appeal before the Hellenic Data Protection Authority.
